By accessing and using WWW.4ARTS.NET - you are subject to the following Terms of Service ("TOS").  These terms may be updated at any time by the owners of this site without notice to you.  You can review the most current terms of service by accessing this page.

1.  Client Usage Only

The only legitimate users of this website are those individuals and businesses who plan to hire or conduct business with our photography and design businesses.  This list is limited to personal portrait clients, wedding photography clients, commercial photography clients, and entertainers seeking portfolio development (actors, models, singers, musicians, and other performers).  All other user is unauthorized.

2. Administrative Fees

Any persons or businesses not meeting the user groups as described in clause number 1 (above) are subjected to Administrative Usage fees for accessing our site in the amount of $10 per day.  These fees are for viewing and access of our pages for personal review and do not include any uses of images or content in any commercial or non-commercial manner that does not have the prior, written permission of this site's owners.

3.  Privacy

By using and accessing this site, you are indicating that you seek photography and design services from our company.  Therefore, any access of our forms or emails to our business will add you to our general mailing list.  Similarly, for best performance of our website, our web pages may store cookies on your computer that allows our web pages to display better on your system and to provide basic information about your browser (Mac vs PC, Internet Explorer vs Firefox) to better customize our future web pages.

4. Site offered "As Is"

You agree that any use of this site or its services are on an "as is" basis and you agree that the site owners assume no responsibility for the timeliness, accuracy, or functionality of these services.  Furthermore, you are responsible for backing up any data that you submit to our site, as this site will not be responsible for any losses, real or otherwise, related to your use of it.  This site may also link to and display advertising from third-party vendors, and attempts to block these advertisements will limit your access to this site.

5. Adults Only

This site is meant for use by adults who are seeking to hire photography and design services.  By using this site, you testify that you are of legal age to form contracts and that you are a citizen of the United States of America. 

6. Misrepresentation

If you post or provide information that is untrue, inaccurate, or incomplete, this site reserves the right to revoke your access and to charge you applicable fees for site usage as posted under term number 2.

7. Misconduct

Any user of this site that harasses, spams, or in any way interferes with the operation or uses of this site is specifically excluded from membership in term number 1, and the site owners reserve the rights to file suit against users of this site for unauthorized activities with a fee of $50 per hour for any efforts expended by the site to contact, clean-up, investigate, or refer to authorities any user's unauthorized activities.

Misconduct includes any activities that harm minors, violate copyrights, interferes with site operations, interferes with operations and uses by other parties, violates any local or state or federal laws, or misrepresents your identity or location.

8. Indemnity / Agreement to Hold as Harmless

You agree to hold this site harmless from any claims made by yourself or any third parties related to your use of this site.  As part of this, you assume any and all responsibility for the copyright infringements for any materials you choose to post to this site, whether knowingly or otherwise.  Further, you accept full responsibility for the safety and adequacy of any information, images, or other content downloaded from this site.   In particular, be wary of information posted by others to our public areas.

9. No Reuse or Resale of Services

You may not reproduce, duplicate, sell, resell, publish, or make any use of this site or any of its contents for any commercial purposes without the prior and express written consent of the site owners upon studio stationary.

10. Confidential and Proprietary

You agree that all information and software on this site, as well as any communications with this site, are to be considered confidential and proprietary information and the sole intellectual property of this site.  Any information submitted to this site by you grants this site a perpetual, non-revocable license to post information to our public and work spaces.   You may not modify, change, reverse engineer, or distribute any information found on this site for any purposes without the prior and express written consent of the site owners.

11. No Warranty

Your use of this service is at  your own risk.  The service is provided "as is" and only to be available as decided by the site owners.  The services and features and pages of this site may change at any time without notice.  The services of this website are offered without warranty of any kind, whether express or implied.

12. Severability

If any items within these Terms of Services are deemed invalid in a particular jurisdiction, all items shall be interpreted sentence-by-sentence, and all non-affected sentences shall remain an intact part of these terms of service.

13. Violations and Complaints

If you have complaints about other users of this system, please contact the site owner for follow-up.
